Terms of Service

1. Agreement to Terms

By accessing our website or using Europa Cargo Solutions services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use our services. These terms constitute a legally binding agreement between you and Europa Cargo Solutions LLC.

2. Services

Europa Cargo Solutions provides logistics services including freight forwarding, customs brokerage, contract logistics, and ancillary services. All services are subject to: (a) these Terms; (b) the applicable Standard Trading Conditions of the relevant national freight association (e.g. FIATA, BIFA, FENEX); and (c) the mandatory rules of any applicable international convention (CMR, Warsaw/Montreal, Hague-Visby).

3. Rates & Quotes

All quotations are provided in good faith based on the information supplied and prevailing market conditions. Quotes are valid for 48 hours unless stated otherwise. Europa Cargo Solutions reserves the right to revise rates if carrier surcharges, fuel levies, currency fluctuations, or other market factors change materially after quote issuance. Final rates are confirmed only upon written booking confirmation.

4. Prohibited Items

The following goods are strictly prohibited from carriage by Europa Cargo Solutions under any circumstances:

  • Illegal narcotics, controlled substances, and psychotropic drugs
  • Weapons, firearms, ammunition, and explosive devices
  • Human remains, organs, or blood products (except under specific medical logistics agreements)
  • Counterfeit or pirated goods and intellectual-property-infringing items
  • Pornographic material illegal under applicable or destination-country law
  • Goods subject to active UN, US, or EU trade sanctions or embargoes
  • Currency (physical banknotes above customs thresholds) without prior written approval
  • Undeclared or mis-described dangerous goods

Dangerous goods that are permitted with prior written approval and appropriate documentation include IMDG/IATA-classified hazardous materials handled under our specialist DG service. The shipper bears full responsibility for accurate declaration.

5. Limitation of Liability

To the extent permitted by law, Europa Cargo Solutions's total liability for any single claim shall not exceed the lower of: (a) the declared value of the goods; or (b) the applicable limit under the governing international convention or Standard Trading Conditions. We exclude liability for consequential, indirect, or pure economic loss unless caused by our gross negligence or wilful misconduct.

6. Claims Policy

Any claim for loss, damage, or delay must be submitted in writing within the following timeframes:

  • Visible damage: Noted on the delivery receipt at time of delivery.
  • Concealed damage: Written notice within 7 calendar days of delivery.
  • Loss: Written notice within 28 calendar days of the expected delivery date.
  • Delay: Written notice within 21 calendar days of actual delivery.

Claims must be submitted to claims@europacargosolutions.com with: the shipment reference, a description of the alleged loss or damage, photographic evidence where available, and the commercial invoice value of the goods.

Claims submitted outside these time limits may be rejected. Europa Cargo Solutions targets acknowledgement within 2 business days and resolution within 30 calendar days of receipt of complete documentation.

7. Governing Law & Disputes

These Terms are governed by the laws of the Netherlands. Any dispute arising out of or in connection with these Terms that cannot be resolved amicably shall be referred to the exclusive jurisdiction of the Rotterdam courts, subject to any mandatory international convention that overrides this choice of forum.
